SC dismisses Zakia Jafri's plea; clean chit given to Narendra Modi and others upheld.

The Supreme Court on Friday dismissed the plea filed by Zakia Jafri, wife of former Congress Parliamentarian Ehsan Jafri, who met an untimely demise owing to the chaos that ensued during the 2002 Gujarat riots.


The plea was against the closure report submitted by the SIT which absolved the then Chief Minister of Gujarat, Narendra Modi and 63 other officials of the state from allegations of orchestrating the riots. The Court had reserved its verdict for the same on December 8, 2021.


The submissions on behalf of the petitioners were made by Senior Advocate Kapil Sibal, while Senior Advocate Mukul Rohtagi appeared for the respondents. The three judge-bench comprising Justice AM Khanwalikar, Justice Dinesh Maheshwari and Justice CT Ravikumar dismissed the plea and ruled in favour of the SIT report.


"We uphold the decision of magistrate in accepting the SIT report and the decision to reject protest petition. This appeal is devoid of merits and dismissed accordingly,"


The SIT was constituted by the Supreme Court in 2008 to look into various trials in relation to the 2002 Gujarat riots and submit a report on the same. The complaint by Zakia Jafri before the then DGP seeking the registration of an FIR, against various state officials and politicians including Modi was also taken into consideration by the SIT.


Thereafter, the SIT gave a clean chit to Narendra Modi and the closure report was upheld by the Magistrate. The same was challenged by the petitioner before the High Court with no respite. Consequently, Zakia Jafri, along with activist Teesta Setalvad moved a Special Leave petition challenging the 2017 judgement of the Gujarat High Court which had accepted the closure report.
